Barona's ($1,000,000 QUACKER DASH^TM) RULES AND REGULATIONS - To benefit the San Diego Blood Bank.

1. Approximately 13,000 ducks will be entered. In the event more than 13,000 ducks are sold, additional ducks may be included.
   
   
2. The rubber ducks will be released into a waterway by the SDBB and/or companies hired by those entities on May 14, 2008 at The Wave Waterpark in Vista, CA.
   
   
3. The length of the course will be determined by the SDBB.
   
   
4. The SDBB, based on total number of entries, will determine the number of ducks dashing in the event. (See rule number 24.)
   
   
5. The dash will begin at approximately 11 a.m. Time is subject to change.
   
   
6. All ducks entered will be provided by the SDBB and shall remain the property of the SDBB.
   
   
7. Once the ducks have been launched, no attempt to free or interfere with any duck is allowed unless deemed necessary by the SDBB.
   
   
8. A number will be assigned to each duck which corresponds to the confirmation code on the entry envelope. Multiple duck entries from one entrant will be assigned additional duck numbers for identification purposes. The persons whose names are associated with winning ducks will be awarded prizes in order of finish.
   
   
9. At the sole discretion of SDBB, we reserve the right to substitute prizes of equal or greater value.
   
   
10. The combined retail value of all prizes is estimated to be $5,507*.
    
    
11. The entry portion of each $1,000,000 Quacker Dash™ envelope must be filled out and delivered to SDBB or an authorized representative of the SDBB Fdn. at 440 Upas St. San Diego, CA 92103, and actually received by SDBB by May 12, 2008 at 4 p.m. Pacific Standard Time. All on-line entries must be received by Monday, May 12, 2008 at Midnight Pacific Standard Time.
    
    
12. No purchase or donation necessary to enter the $1,000,000 Quacker Dash^TM).
    
    
13. All persons must be at least 18 years of age to enter. If the original winner is not 18 years of age or older, they will forfeit any prize, and the prize will be awarded to the first eligible runner up winner.
    
    
14. SDBB board members, employees and their immediate families are not eligible to win prizes.
    
    
15. Proceeds from the $5.00 entry benefit the San Diego Blood Bank's programs and services. SDBB is a qualified, not for profit organization exempt from income tax under Section 501 (c)(3) of the Internal Revenue Act.
    
    
16. Winners will be announced following the $1,000,000 Quacker Dash^TM on Wednesday, May 14th OR Thursday, May 15th. Entrants may also be notified by US mail or telephone. Winners need not be present to win. (See rule number 24 and 25 regarding the $1,000,000 prize.) All other prizes will be awarded.
    
    
17. No CASH prizes will be provided in lieu of designated prizes. Any and all taxes and applicable fees are the sole responsibility of the winners. Restrictions may apply to some prizes.
    
    
18. By entering, entrants release SDBB The Wave Waterpark, Barona Valley Ranch Resort & Casino and its members, officers, directors and other related entities from any and all liability with respect to prizes.
    
    
19. By entering, winners consent to the promotional use of their names and likenesses without additional compensation.
    
    
20. Chances of winning depend on the total number of qualified entries. The odds of winning are approximately 1:13,333
    
    
21. All decisions and interpretations of any rules and/or regulations will be made by SDBB, and its judgment is final.
    
    
22. If SDBB determines that the dash cannot occur for any reason at the scheduled location and time, the SDBB can postpone the dash to another date and time by public announcement thereof, or conduct a random drawing to select the winners.
    
    
23. Copies of these rules and regulations are available by sending a written request to the SDBB Fdn. at the address listed in paragraph 11 above.
    
    
24. Prior to the $1,000,000 Quacker Dash(tm), one Duck number will be pre-chosen at random. The randomly chosen duck number selected shall be conducted by Odds On Promotions and the Duck number will be kept in a sealed security envelope. The randomly chosen duck number represents a duck that could potentially win one million dollars. The $1,000,000 Quacker Dash(tm) officials will be at the finish line when the first four ducks cross and will determine whether one of the four ducks is the pre-chosen million dollar duck. If the number on the bottom of any of the first four ducks across the finish line corresponds to the million dollar duck number, the person whose name appears on the entry envelope corresponding to this number will win $1,000,000.

    If the million dollar prize is awarded, the remaining ducks crossing the finish line will be awarded the First, Second and Third Place Prizes, in the order they crossed the finish line. However, if the number on the bottom of any of the first four ducks to cross the finish line are not one of the pre-chosen ducks, the $1,000,000 prize money will not be awarded. The person whose name appears on the entry envelope corresponding to this number will receive the First Prize only. If ducks that are not purchased are launched in the $1,000,000 Quacker Dash(tm), and the first duck to cross the finish line is an excess duck the $1,000,000 prize will be awarded only if the next purchased duck to cross the finish line is a pre-chosen million dollar duck.
    
    
25. The $1,000,000 Quacker Dash^TM and the SDBB, The Wave Waterpark and Barona Valley Ranch Resort & Casino shall have no obligation or liability with respect to any claims to any Million Dollar Duck or the payment of the $1,000,000 prize. In the event Odds On Promotions fails to discharge its payment obligations to the winner, the Million Dollar Duck winner, if any, agrees to release the $1,000,000 Quacker Dash^TM, SDBB, The Wave Waterpark and Barona Valley Ranch Resort & Casino from any and all liability for any nonpayment of a legitimate claim owed by OddsOn Promotions. Therefore, the winner agrees to look exclusively to Odds On Promotions for such payment.
    
    

*$1,000,000 prize will be awarded if won. Gas awarded is based on an average of 15,000 driving miles per year at 20 miles per gallon and $3 per gallon purchase price which was based on the current price per gallon at press time.
